Petition Demands Restoration of Child to Vegan Parents Wrongfully Charged
Petitioners say carbon monoxide poisoning is the obvious cause of the symptoms that were misdiagnosed as 'malnutrition' via vegan diet, leading to DCFS taking the Thaxton's child from them. They demand that the state of Utah return child and apologize or be charged with aggravated kidnapping.

Bountiful, UT December 16 2003--An online petition has been created to allow concerned citizens to voice their support for the parents of Matthew Thaxton, and to demand that the State of Utah immediately release him into the care of his parents.
The infant was taken from his parents by the Division of Children and Family Services (DCFS) on June 9, 2003 on charges purporting malnourishment through their vegan diet. The state also had charged the parents with "substantive neglect" in the death of their son Dan Jr. the year prior.
The petition states that "The true and clear cause of Daniel's death as well as of Matthew's illness is Carbon Monoxide poisoning from the Thaxton home furnace exhaust being situated too close to the fresh air intake (a situation that was in place at the time they purchased the home in good faith)."
Situating an HVAC exhaust too close to a fresh air intake is a violation of code, and "was overlooked by the installer, and the inspectors (if the installation was done legally), and the home appraiser, and the real estate agent, and the city meter readers."
"You can't expect the average home owner to know something like that," said Thomas Rodgers, who was the one who identified "the true smoking gun in this tragedy." Rodgers was a dairyman before he became vegan following an instance in which he was medically dead for several minutes. When he came to, the first words he mustered were, "nothing else is to die that I might live."
The petition warns the state that if they do not return the child, and clear the parents of all charges levied against them in this case and in the case of their son Dan Jr., and produce a sincere public apology, that the petitioners will launch a class action law suit against the state, levying a charge of aggravated kidnapping.
The petition refers to the existence of other similar cases of the State's abuse of power, such as the Parker Jenson case. Parker was taken from his parents because they did not agree with a Doctor's insistence on performing chemotherapy on their son.
It also warns Primary Children's Medical Center that a malpractice law suit is in order, saying that among its barrage of tests and false diagnosis, it did not administer the "clearly indicated carboxy hemoglobin test, which would have identified the true cause of malaise early on."
If the state, the DCFS, and the hospital admit to their mistake and present sincere public apologies and seek to assure that such abuses are not repeated in the future, the petition calls upon the parents of Matthew Thaxton to forgive them. Otherwise, it calls on them to invoke their remedies at law.
The petition was composed by Sterling D. Allan, of Patriot Saints for Parental Rights, where a press release was published regarding the plight of the Thaxton family. The site also features the Parker Jensen case, along with a chronology of their internationally observed saga.
In the first 24 hours, the petition garnered nearly 60 signatures, posted on the afternoon of Dec. 14.
